1. The agreement
In plain termsUsing CraftCanvas means you accept these terms. If you do not agree with them, do not use the service.
These Terms of Service are a contract between you and Cub Lake Capital LLC, the Ohio company that operates CraftCanvas ("we", "us"). They cover the CraftCanvas web app at https://www.craftcanvas.app, the CraftCanvas iOS app, and every account, pattern, and purchase made through them (together, "the service").
By creating an account or using the service you agree to these terms and to our Privacy Policy, which explains how we handle your information. If you use the iOS app, Apple's standard terms for App Store purchases also apply to what you buy there.
2. Your account
- You must be at least 13 years old to use CraftCanvas. If you are under 18, you need a parent or guardian's permission.
- Give us accurate information when you sign up and keep your email address current, because that is how we reach you about your account and your subscription.
- Keep your password to yourself. You are responsible for what happens under your account. If you think someone else has access to it, change your password and tell us.
- One person, one account. You may not create accounts for other people or transfer your account to someone else.
3. Plans, billing, and cancellation
In plain termsThe Free plan costs nothing. Maker and Artisan renew automatically until you cancel. Cancel any time; you keep what you paid for until the end of the period.
Plans
CraftCanvas has three plans: Free, Maker, and Artisan. What each includes is described on the plans table, which is part of these terms. We may change what a plan includes; if a change removes something you are paying for, we will tell you at least 30 days before it takes effect and you may cancel.
Billing
- Paid plans are billed in advance, monthly or yearly, at the price shown when you subscribe. Prices are in US dollars and exclude any sales tax we are required to collect.
- Your subscription renews automatically at the end of each period, and the payment method on file is charged, until you cancel.
- On the web, payments are processed by Stripe. In the iOS app, payments are processed by Apple, and Apple's terms govern renewal, cancellation, and refunds for those purchases.
- If a payment fails, we will retry it and email you. If it still fails after our retries, your subscription is canceled and your account moves to the Free plan. Your projects are not deleted.
- If we change a price, we will email you at least 30 days before the new price applies to your renewal. Continuing past that date means you accept the new price.
Upgrades and downgrades
You can switch between Maker and Artisan, or between monthly and yearly billing, from Settings. Switching takes effect immediately, and the difference is prorated: you are charged or credited for the unused part of the current period.
Cancellation
Cancel from Settings or the billing portal at any time. Your paid features stay on until the end of the period you have already paid for, then your account moves to the Free plan. Nothing is deleted; projects beyond the Free plan's limits stay readable, you just cannot add more until you upgrade again.
Refunds
Because you can cancel at any time and keep access to the end of the period, we do not refund partial periods. If you were charged by mistake, or CraftCanvas did not work for you, email us within 14 days of the charge and we will make it right, including a refund where that is the right answer. Where the law gives you a stronger right to a refund, that law applies.
Trials and promotions
We sometimes offer a trial of a paid plan, or a launch period during which paid features are open to everyone. Trials and promotions end on the date we state, and when they end your account is treated according to the plan you actually have. We can change or end a promotion at any time; we will not charge you for one without your agreement.
4. Your patterns and content
In plain termsYour work is yours. We only get the permission we need to store it, show it to you and the people you share it with, and run the service. You are responsible for having the rights to images you upload.
You own it
You keep every right you have in the patterns, images, palettes, and other content you create or upload ("your content"). We claim no ownership in it. Patterns you design in CraftCanvas are yours to sell, print, publish, and give away as you see fit.
The license you give us
So that we can run the service, you give us a worldwide, non-exclusive, royalty-free license to store, copy, convert, display, and transmit your content, only as needed to provide the service to you and to the people you choose to share it with. This license ends when you delete the content or your account, except for copies that are already in backups or that other users have exported with your permission.
Sharing and publishing
When you share a project with collaborators, they can view and, if you allow it, edit it. When you publish a pattern to the community, you allow other CraftCanvas users to view it, follow it, and make it for themselves. Publishing does not give anyone the right to resell your pattern or claim it as their own. You can unpublish at any time.
Your responsibilities
- Only upload images and designs you have the right to use. Converting a photograph you do not own, or a copyrighted character, into a pattern may infringe someone's rights, and you are responsible for that, not us.
- Do not publish content that is illegal, hateful, sexually explicit, or that harasses or impersonates anyone. This covers everything other makers can see: published patterns and their titles, descriptions and tags, shared palettes and their names, your username, your profile text and picture, and, on the Artisan plan, your studio name, tagline, logo, colors and links. We may hide a profile that breaks these rules while leaving the account open, and we will tell you why.
- Bead, floss, and drill catalogs in CraftCanvas reference manufacturer product codes so your patterns use real materials. Those brand names and codes belong to their manufacturers, who are not affiliated with CraftCanvas.
Copyright complaints
If you believe content on CraftCanvas infringes your copyright, email craftcanvas.support@gmail.com with the pattern's link, a description of the work you own, your contact details, and a statement that you believe in good faith the use is not authorized. We respond to valid notices by removing the content and, for repeat infringers, closing accounts.
5. Acceptable use
Use CraftCanvas for designing and making things. Do not:
- Break the law, or infringe anyone's rights, while using the service.
- Try to get around plan limits, feature gates, or billing, or share one paid account between several people.
- Scrape, bulk download, or copy the material catalogs, published patterns, or other data from the service by automated means.
- Probe, overload, or interfere with the service or its security, or access another user's account or data.
- Reverse engineer the service, or use it to build a competing product.
- Upload malware, spam the community, or use the service to send unsolicited messages.
If you break these rules we may remove content, limit features, or close your account, and we will tell you why unless the law prevents it. Automated checks may flag something you publish for us to look at, and we may hold it for a short review before it appears to other makers.
6. What belongs to us
CraftCanvas itself, including its software, design, stitch layouts, material matching, catalogs as compiled by us, documentation, and the CraftCanvas name and logo, belongs to Cub Lake Capital LLC and is protected by copyright and trademark law. These terms give you a personal, non-transferable right to use the service; they do not give you any ownership of it. Feedback you send us may be used to improve the service without any obligation to you.
7. Third-party services
The service depends on other companies, such as Stripe and Apple for payments, Google and Apple for sign in, and hosting providers listed in our Privacy Policy. Their terms apply to your use of their services. We are not responsible for their acts or omissions, though we choose them carefully.
8. Ending the agreement
In plain termsYou can leave any time by deleting your account. We can close accounts that break these terms, and we will give notice if we ever shut the service down.
- By you. Delete your account from Settings. Your account is hidden immediately, any subscription is set to end at the close of the current billing period, and you can restore the account by signing in within 30 days; after that it is permanently deleted. Export any patterns you want to keep first.
- By us. We may suspend or close your account if you materially breach these terms, if we are required to by law, or if your account has been inactive on the Free plan for more than two years. Except where you have breached the terms, we will give you notice and time to export your work.
- If we stop the service. If we ever discontinue CraftCanvas, we will give at least 90 days' notice, keep exports working during that time, and refund the unused portion of any yearly subscription.
Sections about your content, what belongs to us, disclaimers, limitation of liability, and disputes survive the end of this agreement.
9. Disclaimers
In plain termsWe work hard to make CraftCanvas accurate, but bead colors on a screen are not beads in your hand, and software has bugs. Check before you buy materials.
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. In particular:
- Color matching, material quantities, and catalog data are estimates based on manufacturer information and our own measurements. Dye lots, finishes, and screens vary. Verify quantities before purchasing materials, and do not rely on a screen color as a substitute for a physical sample.
- We do not guarantee the service will be uninterrupted, error-free, or that your work will never be lost. Export patterns you care about.
- Patterns published by other users are their responsibility, not ours. We do not review them for accuracy or for rights clearance.
Some places do not allow these disclaimers, in which case they apply as far as the law permits.
10. Limitation of liability
To the fullest extent the law allows, Cub Lake Capital LLC and its owners, employees, and providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of materials, arising from your use of the service, however caused, even if we were told they were possible.
Our total liability to you for all claims arising from the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Nothing in these terms limits liability that cannot be limited by law, including for fraud, or your rights as a consumer under the laws of the place where you live.
11. Your responsibility for claims
If someone brings a claim against us because of content you uploaded or published, or because you used the service in a way that breaks these terms or the law, you agree to cover our reasonable costs of dealing with that claim, including legal fees. We will tell you promptly about any such claim and let you take part in defending it.
12. Governing law and disputes
In plain termsOhio law applies. If something goes wrong, email us first; most problems are fixed in a reply. Anything that reaches a court goes to the courts in Lucas County, Ohio.
These terms are governed by the laws of the State of Ohio and the United States, without regard to conflict of law rules. Before starting any formal proceeding, contact us at craftcanvas.support@gmail.com and give us 30 days to resolve the problem informally. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in Lucas County, Ohio, and you consent to their jurisdiction. If you live outside the United States, you may also have the right to bring a claim in your own country under its consumer protection laws, and these terms do not take that right away.
13. Changes to these terms
We may update these terms as the service changes. When we do, we will update the effective date at the top. For changes that affect your rights or what you pay, we will email you or show a notice in the app at least 30 days before they take effect. Using the service after that date means you accept the updated terms; if you do not, cancel and delete your account before then.
14. Everything else
- These terms, the Privacy Policy, and the pricing page are the whole agreement between us about the service.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we do not enforce a term right away, we can still enforce it later.
- You may not assign this agreement; we may assign it to a successor that continues to operate the service under these terms.
- Notices to you go to the email on your account. Notices to us go to the email address below; if you need a postal address to serve a legal document, email us and we will provide one.
